1. Introduction and Acceptance

These Terms and Conditions govern the use of services provided by serenitesa, a senior residential care facility located in Hua Hin, Thailand. By inquiring about our services, visiting our facility, using our website, or entering into a care agreement with us, you accept and agree to be bound by these terms.

If you do not agree with any part of these terms, please do not use our services or website. We recommend reading these terms carefully before engaging with our services.

2. Definitions

For the purposes of these Terms and Conditions:

  • "serenitesa," "we," "us," or "our" refers to the senior residential care facility and its staff
  • "Resident" refers to individuals receiving care services at our facility
  • "Family Member" or "Representative" refers to authorized individuals acting on behalf of a resident
  • "Services" refers to all care, accommodation, activities, and support provided by serenitesa
  • "Agreement" refers to the formal care contract entered into between serenitesa and residents or their representatives

3. Eligibility and Admission

3.1 Age Requirement

Our services are designed for adults aged 60 and above. We may consider younger applicants on a case-by-case basis depending on individual circumstances and care needs.

3.2 Service Scope

serenitesa provides non-medical residential care and support services. We are not a medical facility and do not provide nursing care or intensive medical supervision. Residents requiring specialized medical care should arrange such services independently with qualified healthcare providers.

3.3 Assessment Process

Before admission, prospective residents undergo an assessment to determine whether our services are appropriate for their needs. We reserve the right to decline admission if we cannot adequately meet an individual's care requirements.

4. Service Agreement and Care Plans

4.1 Written Agreement

All residents or their authorized representatives must enter into a written service agreement that specifies the type of care to be provided, fees, payment terms, and other important conditions.

4.2 Individualized Care Plans

Care plans are developed collaboratively with residents and family members, outlining daily routines, preferences, and support needs. These plans are reviewed quarterly or as needed when circumstances change.

4.3 Modifications

Care plans and service levels may be adjusted based on changing needs. Any modifications affecting fees or service scope require mutual agreement and written documentation.

5. Fees and Payment

5.1 Service Fees

Monthly fees are payable in advance by the first day of each month. Fees are specified in the service agreement and may vary based on the level of care selected. All fees are denominated in Thai Baht.

5.2 Payment Methods

Payments may be made by bank transfer, check, or other methods specified in the service agreement. Late payments may incur administrative fees as outlined in the agreement.

5.3 Fee Adjustments

We reserve the right to adjust fees annually to reflect changes in operational costs. Residents will receive at least 60 days' written notice of any fee increases.

5.4 Additional Services

Services not included in the standard monthly fee, such as specialized transportation or additional outings, will be charged separately and billed monthly.

6. Resident Responsibilities

Residents and their representatives agree to:

  • Provide accurate information about health conditions, medications, and care needs
  • Update staff promptly about any changes in health status or personal circumstances
  • Treat staff, other residents, and visitors with courtesy and respect
  • Respect community guidelines regarding shared spaces and activities
  • Make timely payments according to the agreed schedule
  • Maintain appropriate insurance coverage as specified in the service agreement
  • Notify staff before leaving the facility for extended periods

7. Our Responsibilities

serenitesa commits to:

  • Provide care services as outlined in the service agreement and care plan
  • Maintain a safe, clean, and comfortable living environment
  • Treat all residents with dignity, respect, and cultural sensitivity
  • Protect resident privacy and confidentiality
  • Communicate openly with residents and family members
  • Provide regular updates on wellbeing and activities
  • Maintain appropriate staffing levels for quality care delivery

8. Termination

8.1 Voluntary Termination by Resident

Residents may terminate services at any time with 30 days' written notice. Fees are non-refundable for the notice period, regardless of whether the resident remains at the facility.

8.2 Termination by serenitesa

We may terminate services under the following circumstances, with appropriate notice period:

  • Non-payment of fees after 15 days past due date
  • Resident's needs exceed our non-medical care capabilities
  • Behaviors that jeopardize the safety or wellbeing of staff or other residents
  • Violation of community guidelines after reasonable attempts at resolution

8.3 Notice Requirements

Except in cases of immediate safety concerns, serenitesa will provide at least 30 days' written notice of termination and will work with the family to arrange alternative care arrangements.

9. Limitation of Liability

While we take reasonable precautions to ensure resident safety and wellbeing, serenitesa is not liable for:

  • Health complications or medical conditions that arise despite appropriate non-medical care
  • Loss or damage to personal property, though residents are encouraged to maintain appropriate insurance
  • Injuries resulting from a resident's own actions or pre-existing health conditions
  • Service interruptions due to circumstances beyond our reasonable control

Our total liability under any service agreement is limited to the amount of fees paid during the three months preceding the claim.

10. Privacy and Confidentiality

We maintain strict confidentiality regarding resident information as outlined in our Privacy Policy. Personal information is shared only:

  • With designated family members and emergency contacts as authorized
  • With healthcare providers when coordinating care
  • As required by law or to protect safety

11. Dispute Resolution

11.1 Informal Resolution

We encourage open communication to resolve concerns. Any disputes should first be brought to the attention of our management team, and we will make good faith efforts to reach an amicable resolution.

11.2 Governing Law

These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any legal proceedings must be brought in the courts of Prachuap Khiri Khan Province or Bangkok, Thailand.

11.3 Mediation

If informal resolution is unsuccessful, parties agree to attempt mediation before pursuing litigation. Mediation costs will be shared equally unless otherwise agreed.

12.1 Content Accuracy

We strive to maintain accurate information on our website, but details about services, pricing, and availability are subject to change. Please contact us directly to confirm current information.

12.2 Intellectual Property

All content on our website, including text, images, and design elements, is owned by serenitesa or used with permission. You may view and print content for personal reference but may not reproduce or distribute it commercially without written permission.

13. Changes to Terms

We may update these Terms and Conditions periodically to reflect changes in our practices or legal requirements. Material changes will be communicated to current residents and their families. Continued use of our services after changes constitute acceptance of the updated terms. The effective date at the top of this document indicates when terms were last modified.

14. General Provisions

14.1 Entire Agreement

These Terms and Conditions, together with the specific service agreement and care plan, constitute the entire agreement between serenitesa and residents regarding services provided.

14.2 Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full effect.

14.3 No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or our right to enforce it in the future.

14.4 Assignment

Service agreements may not be transferred or assigned without our written consent. We reserve the right to assign our obligations to a qualified successor entity with appropriate notice to residents.
